When AI goes to court: managing AI use by litigants in person – Dentons

‘Litigants in person (LiPs) are increasingly using artificial intelligence (AI) tools to assist in English civil litigation, for example to draft correspondence, prepare statements of case or other court documents, and identify and summarise relevant cases in support of their arguments. Given access to legal representation remains a significant issue in English civil litigation,¹ AI is gaining importance as a means of allowing LiPs to bring their claims. However, as will be seen, the use of AI by LiPs also places a significant burden on the courts and opposing parties. How should defendants to litigation brought by AI-assisted LiPs address this new and unpredictable way of pursuing claims?’
